Welcome to TidalWaveCourier. By utilizing our shipping, logistics, and delivery services, you (the "Customer") agree to be bound by the following terms and conditions.

1. Scope of Service

TidalWaveCourier provides pick-up, transport, and delivery services for parcels. We reserve the right to refuse any shipment that does not comply with our safety standards or legal requirements.

2. Customer Responsibilities

To ensure a smooth delivery, the Customer agrees to:

● Accurate Labeling: Provide precise recipient names, addresses, and contact numbers.

● Packaging: Securely pack all items to withstand standard handling. TidalWaveCourier is not liable for damage resulting from inadequate packaging.

● Contents Disclosure: Honestly declare the contents and value of the shipment.

3. Prohibited Items

We do not ship the following:

● Hazardous materials (flammables, explosives, toxins).

● Illegal contraband or controlled substances.

● Perishables (unless pre-authorized via cold-chain agreement).

● Currency, bullion, or high-value jewelry.

4. Shipping Fees and Payments

● Rates: Fees are calculated based on weight, dimensions, distance, and speed of service.

● Surcharges: Additional fees may apply for remote areas, failed delivery attempts, or address corrections.

● Payment: All services must be paid in full at the time of booking unless a corporate credit account has been established.

5. Liability and Insurance

● Standard Liability: Our liability for loss or damage is limited to a maximum of $100 per shipment unless additional "Declared Value" coverage is purchased.

● Exclusions: We are not liable for delays caused by "Acts of God" (weather, natural disasters), customs clearance, or incorrect information provided by the Customer.

6. Delivery Timeline

While we strive for "Tidal Wave" speed, delivery dates are estimates and not guarantees, unless a specific "Guaranteed Express" service is purchased.

7. Right to Inspect

TidalWaveCourier and government authorities (such as Customs) reserve the right to open and inspect any shipment at any time without prior notice to ensure safety and legal compliance.

8. Claims

Any claims for loss or damage must be submitted in writing within 14 days of the scheduled delivery date. Original packaging must be retained for inspection.

At TidalWaveCourier, we respect your privacy. This section outlines how we collect, use, and protect the personal data of both the Sender and the Recipient.

A. Information We Collect

To facilitate delivery, we collect the following information:

● Contact Details: Name, physical address, email address, and phone number.

● Payment Information: Credit card details (processed through secure, encrypted third-party gateways; we do not store raw card data).

● Metadata: IP addresses, device types, and tracking history for security and service optimization.

B. How We Use Your Data

Your data is used strictly for the following purposes:

● Service Fulfillment: Sharing the Recipient's address and phone number with our couriers and logistics partners to complete the delivery.

● Notifications: Sending SMS or email updates regarding the status of a shipment.

● Security: Monitoring for fraudulent activity or unauthorized account access.

C. Data Sharing and Third Parties

We do not sell your personal information to third-party marketers. We only share data with:

● Sub-Contractors: Independent drivers or regional carriers necessary to complete the "last mile" of delivery.

● Legal Authorities: When required by law, such as for customs declarations or law enforcement subpoenas.

D. Data Retention

We retain shipment records for a period of 7 years to comply with tax, audit, and legal requirements. After this period, personal identifiers are anonymized or securely deleted.

E. Your Rights

Depending on your jurisdiction, you may have the right to:

● Request a copy of the personal data we hold about you.

● Request the correction of inaccurate data.

● Opt-out of non-essential marketing communications.

Prohibited Items:

TidalWaveCourier maintains a strict policy to ensure the safety of our couriers and the public. The Customer warrants that the shipment does not contain:

● Hazardous Goods: Chemicals, pressurized canisters, lithium batteries (unless properly declared/labeled), and flammable liquids.

● High-Value Assets: Negotiable instruments (cash, bonds, coupons), precious stones, and antiques exceeding a value of $5,000 USD.

● Restricted Goods: Firearms, ammunition, or tobacco/alcohol products without appropriate licensing and pre-approval.

● Bio-hazards: Clinical or medical waste, including biological samples not sealed according to IATA standards.

● Note: Attempting to ship prohibited items may result in the immediate disposal of the parcel without compensation and potential reporting to law enforcement.

Expanded Section 5: Limitation of Liability

By using our services, you acknowledge that TidalWaveCourier is not an "all-risk" insurer. Our liability is capped to prevent business disruption from unforeseen shipping variables:

1. Indirect Loss: We are not liable for any "consequential losses," including loss of profits, business opportunities, or emotional distress caused by a delayed or lost package.

2. The "Act of God" Clause: We are not responsible for delays or damage caused by circumstances beyond our control, including but not limited to:

■ Extreme weather (hurricanes, floods, "tidal waves").

■ Civil unrest or strikes.

■ Global supply chain disruptions.

3. Maximum Payout: In no event shall our liability exceed the actual depreciated value of the contents or the $100 standard limit (whichever is lower), unless the Customer purchased Supplemental Protection at checkout.

● How Claims Work (Step-by-Step)

If a package arrives damaged, the following process must be followed:

1. Notification: Email [email protected] within 14 calendar days.

2. Evidence: Provide high-resolution photos of the outer packaging, the inner packing material, and the damaged item.

3. Retention: Do not throw away the box. We may require a physical inspection by a third-party adjuster to verify the claim.

4. Resolution: Valid claims are typically processed within 10 business days of receiving all required documentation.
